Nicholas and Company Foodshow

Program Description

Premium prize options for Nicholas and Company's "Family Owned, Locally Rooted" and "Rooted in your Community" 2013 Foodshows will be greatly expanded this year. Hundreds of thousands of items will be available for redemption of your food show points.

How to Participate

It is simple to participate in the foodshow premium program:

  • Book product at the foodshow.
  • Applicable program shipping dates to earn points:                    

                    -Dixie/Moab Food Show March 17th-May 11th, 2013
                    -Fort Hall Food Show May 13th-June, 23rd, 2013
                    -Big Show June 23rd-August 31st, 2013
                    -Boise/Twin Food Show September 22nd-November 16th, 2013
                    -Winter Food Show November 17th-January 25th, 2014

            

  • Take Delivery of the product over 10 weeks.                    
  • The more product purchased, the more points earned.
  • Redemption period ends on Februrary 13th, 2014.                    
  •  -Prize/credit redemptions must be submitted before the end date.
                        -Free shipping on all orders.
  • Customer must be in good credit standing in order to earn and redeem points.
  • Points earned only on products purchased and delivered.
  • Customer must earn the mandatory minimum of 8,500 points in order to be eligible.

How to Track Your Foodshow Points

  • Log-in to check your points earned (total updated weekly).
                    -The web site is www.nicholasfoodservice.com.
                    -Your user name is your customer number.
                         *Refer to the number on your foodshow buyer card or summary.
                    -Your temporary password is nicholas (all lower case)
                         *Follow the steps to register, including changing your password.

Redemption

Participants redeem foodshow prizes by logging onto the website, reviewing available points, and searching for prize merchandise equal to or less than the participants accrued point total.

Prize's are not transferable to other participants or any other person. Prize's are not redeemable for cash. Points applied to your Nicholas and Company account must be added all or nothing. Participants who redeem a prize are not eligible to apply credits to their account.

Awards

Awards can be viewed by going to http://www.nicholasfoodservice.com and logging in with the participant's customer number/password. Gifts can be searched by category, item description, or point total.

Miscellaneous

Verified Award Points may be redeemed for merchandise/credits only as stated in these Terms and Conditions. There is no cash alternative. Nicholas and Company reserves the right to substitute similar or better quality merchandise or to substitute manufacturers in the event of unavailability, or both.

The Nicholas and Company Foodshow points are not transferable under any condition. All claims are subject to verification by Nicholas and Company, whose decisions as to the validity of the points earned and matters relating to this program are final.

Participant must refer to all warranty information included with merchandise and contact manufacturer for repairs.

By participating in this program, the participant agrees to release and hold harmless Nicholas and Company and its Redemption Company and their respective officers, directors, employees from and against any claims or causes of action arising out of participation in the program or out of receipt or undelivered merchandise selected pursuant to this program.

Nicholas and Company is not responsible for failed, partial or garbled computer transmissions; or for technical failures of any kind, including, but not limited to, electronic malfunctioning of any network, hardware, or software or electronic or human error that may occur in the processing of entries. Nicholas and Company reserves the right to disqualify any individual found to be tampering with the entry process or with the operations of the program, or to be acting in violation of these Terms and Conditions.

Any and all disputes, claims, and causes of action with Nicholas and Company arising out of or connected with this Program, the determination or validity of claims, shall be resolved individually and exclusively by arbitration under the Commercial Dispute Resolution Procedures. Any and all claims, judgments and settlements shall be limited to actual out of pocket costs incurred, including costs associated with participating in this program, but not attorneys' fees. Participants hereby waive all rights (1) to claim or be awarded any punitive, direct, indirect, incidental and consequential damages and any other damages, other that for actual out of pocket expenses, and (2) to have damages otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions shall be governed by the construed in accordance with the laws of the state of Utah.

Nicholas and Company reserves the right in its sole discretion to cancel or modify this program at any time. Any modification of these terms and conditions shall be communicated to Participants via e-mail, mail or payroll or will posted on the program web site at http://www.nicholasfoodservice.com.
